Part Time Employment : Unpermitted Work Categories and Criteria for Handling Violations

We would like to provide our international students with additional information regarding part-time employment permits. Please be aware that certain fields of work are prohibited, and there are strict criteria for handling violations. We urge you to refer to the information below carefully and to exercise caution to avoid engaging in any forms of illegal employment.

 

Prohibited fields of work and cases

 - Construction or Manufacturing Industry (as per their business licenses)

 - Occupations that fall under the E-1~E-7, E-9 and E-10 visa categories (https://www.visa.go.kr/openPage.do?MENU_ID=10102)

 - Language schools or institutes for minors (ex. English kids cafe, Youth english camp, Kids English academy, etc)

 - Indirect Employment (ex. Delivery rider)

 - Dispatched, subcontracted, or brokered employment arrangements

 - Distant Workplaces (Over a 1.5 hour commute from the university or one’s residence)

 

Criteria for Handling Violators


 - Employment without Permit The employees and their employers will be punished in accordance with Article 18 of the Act for engaging in illegal employment. This may result in compulsory eviction, denial of permission to stay, or other penalties based on examination decisions.

 

  1) Upon first detection : In the event that the violation is deemed to be minor upon detection, the offender may be permitted to remain in Korea after settling the fines. Nevertheless, the offender will be disallowed from engaging in part-time work for a duration of one year after the fine settlement.

 

  2) Upon Second detection : Forced eviction will be imposed without exception.

    ※ Regardless of the number of detections, if the violation occurs in the construction industry, violators will be ordered to leave the country without exception.

 

 - Breach of Permit Conditions for employment (after the permission was granted)

  1) Upon first detection : the violator will be prohibited from part-time employment for one year.

  2) Upon second detection : the violator will be prohibited from part-time employment during their entire study period.


  3) Upon third detection : the violator's study visa will be cancelled.
